Privacy Policy and Terms of Service
Last updated: March 5, 2026
1. Introduction
VisionTag AI ("we", "us", "our", or the "App") is operated by an independent solo developer. This Privacy Policy explains how we collect, use, store, and protect information when you install and use our Shopify application. By installing or using the App, you agree to the practices described in this policy.
2. Information We Collect
When you install and use VisionTag AI, we access and process the following information from your Shopify account:
- Store Information: Shop name, domain, email address, and country (provided by Shopify during app installation).
- Product Data: Product titles, images, image URLs, and tags necessary to provide our core AI tagging service.
- Billing Information: Subscription and payment status (processed entirely through the Shopify Billing API; we do not collect or store credit card or payment details).
- Usage Data: Monthly usage counts and feature interactions for service operation and rate limiting.
We do not collect personal data of your customers, including names, email addresses, shipping addresses, or payment information.
3. How We Use Your Information
We use the collected information strictly for the following purposes:
- To provide the App's core functionality: generating AI-powered alt text, titles, and tags for your product images.
- To process subscriptions and billing through the Shopify Billing API.
- To enforce usage limits and maintain fair use of the service.
- To provide customer support when you reach out to us.
- To improve, debug, and maintain the App.
4. Data Sharing and Third-Party Services
We do not sell, rent, or trade your data. We share information only with the following third parties, solely to provide our services:
- Google Gemini API: Product image URLs are sent to Google's AI model for analysis and tag generation. No personal or customer data is shared with Google. Google's use of this data is governed by Google's Privacy Policy.
- Shopify: Generated tags, alt text, and metadata are synced back to your Shopify store via Shopify's APIs.
- Hosting Provider: The App is hosted on cloud infrastructure. Your data may be processed on servers located outside your country of residence.
5. Data Storage and Security
Your data is stored in a secure PostgreSQL database hosted by a third-party cloud provider. We implement reasonable technical and organisational measures to protect your data against unauthorised access, alteration, disclosure, or destruction. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
6. Data Retention
We retain your data for as long as you have the App installed. Upon uninstallation of the App, we will delete your store data, product data, and generated tags from our systems within 30 days. Aggregated, anonymised usage statistics may be retained indefinitely.
7. Your Rights
Depending on your jurisdiction, you may have the following rights regarding your personal data:
- Access: Request a copy of the data we hold about your store.
- Correction: Request correction of inaccurate data.
- Deletion: Request deletion of your data (also fulfilled automatically upon app uninstallation).
- Portability: Request your data in a machine-readable format.
- Objection / Restriction: Object to or request restriction of certain data processing activities.
To exercise any of these rights, please contact us using the details in Section 12 below.
8. GDPR Compliance (European Economic Area)
If you are located in the European Economic Area (EEA) or the United Kingdom, the General Data Protection Regulation (GDPR) applies to our processing of your data. Our lawful bases for processing are:
- Contract: Processing necessary to provide the App's services as agreed upon installation.
- Legitimate Interest: Processing necessary for improving the App, debugging, and ensuring security.
- Consent: Where required, we will obtain your explicit consent before processing.
Your data may be transferred outside the EEA (e.g., to servers in the United States or other regions). We rely on appropriate safeguards, including standard contractual clauses, to ensure an adequate level of data protection.
9. DPDPA Compliance (India)
If you are located in India, the Digital Personal Data Protection Act, 2023 (DPDPA) applies. In accordance with the DPDPA:
- We process personal data only for the lawful purposes described in this policy.
- We collect only the data that is necessary for providing the App's services.
- You have the right to access, correct, and request erasure of your personal data.
- You may nominate another person to exercise your data rights on your behalf.
- You may withdraw consent at any time by uninstalling the App; withdrawal does not affect the lawfulness of prior processing.
- If you have a grievance, please contact us using the details in Section 12. We will respond within 30 days.
10. Limitation of Liability
The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of business, loss of data, or loss of goodwill, arising out of or in connection with your use of the App.
- We shall not be liable for any damages arising from AI-generated content, including inaccurate, incomplete, or inappropriate alt text, tags, or titles produced by the App.
- We shall not be liable for any losses resulting from third-party service outages (including Shopify, Google APIs, or our hosting provider).
- Our total aggregate liability for any claims arising from or related to the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
- You are solely responsible for reviewing and approving all AI-generated content before it is published to your Shopify store.
11. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. The updated policy will be posted at this URL with a revised "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the revised policy.
